License Name: Commercial Use License – Artistic Happiness Digital Graphics, Vector Art and Scalable Vector Graphics (.SVG), mockups and templates.
License Type: Non-exclusive, Non-transferable
Applies To: A single purchase of a digital graphic file sold under the Artistic Happiness brand. You will need to purchase a separate commercial license for EACH graphic you wish to use commercially.
The license is a single user license for ONE digital graphic, vector art, scalable vector graphics (.svg), mockup or template. It cannot be sub-licensed, resold, transferred, or redistributed in any way. This means, you can purchase this file for you to use, to create final products such as shirts, wall art, drink ware, towels, garden flags, bags, pillows, stickers, tattoos, hats for your small business. However, you cannot give the file away, sell it or share it. And, they (the graphics themselves), may not be offered for sale (e.g. reselling to a stock resource website) or given away.
You cannot sell this design or portray it as your own. Each graphic and design has been registered with the US Copyright office in the United States of America. Artistic Happiness also retains all rights to the creation of the graphic and design as once it’s created, it’s considered my property. Even if you don’t live in the United States of America, my original graphics and designs are protected as an artist at the creation of the graphic and design. I’m selling the license to you, for you to use for your own use or for your small business. This does not mean you own the graphic or design.
Please read the Terms of Service and Use on Artistic Happiness. Purchasing this license doesn’t release the Terms of Service and Use in any way.
What This License Allows:
- Use of Artistic Happiness digital graphics in up to 500 units of physical or digital products for sale (e.g., t-shirts, bags, stickers, planners, invitations).
- Creating a limited number of physical stickers, decals, or other adhesive end products to sell, as long as they are made solely by the licensee using their own equipment. This includes, but is not limited to: planner stickers, address labels, wall decals, laptop decals, and car window decals. This is limited to 1,000 items.
This section does not include items which require additional heat, machine, or chemical processing to create a finished physical object, such as iron-on transfers or screen printing, DTG, DTF, vinyl printing, plastisol transfers or embroidery. You may use my graphics and/or designs to print sublimation transfers or vinyl transfers that you in turn use for final products that you sell through your small business. Please read the Terms of Service and Use for more information on what’s limited even with a extended commercial license.
- Using purchased graphics, illustrations, or clipart as flat, unmovable display images in an app, program, or game, as long as the image files are encoded, protected, or hidden so that the end user cannot extract those image files from the app, program, or game.
Small business use:
- Use in branding or marketing materials for small businesses. You can use Artistic Happiness graphics for advertising such as flyers.
- An Artistic Happiness logo creation carries it’s own terms of use. Please contact me for logo creation.
- Business Stationery and Product Packaging. Using graphics to create physical products related to a business, including but not limited to: business cards, stationery, letterhead, brochures, and flyers; as long as those products are printed by the licensee using their own equipment.
- Using graphics to create physical packaging for products, including but not limited to: boxes, bottles, bags, and other containers; as long as those packages are printed by the licensee using their own equipment.
Please purchase an extended commercial license to create more than 500 items. Please contact Artistic Happiness for this license.
What This License Does NOT Allow:
- Reselling, sharing, or redistributing the graphics as-is or in editable format (e.g., selling the original PNG, SVG, or PSD files).
- Creating a digital product to sell/distribute where graphics, illustrations, clipart, or other design objects are used as-is or nearly as-is, or closely resemble the design element purchased from us.
- Claiming the artwork as your own.
- Using the graphics in designs that violate copyright, trademark, or are offensive/hateful in nature. See the Terms and Service Use for more details.
- Use in AI image generators or NFTs.
- Use in social media posts or social media accounts.
- Broadcast and streaming of any sort, including but not limited to: broadcast and streaming via network, cable, internet, satellite, pay-per-view, video on demand or Streaming of motion picture and /audiovisual works, including advertisements.
- Use in e-books or e-publications.
- You cannot use any of my designs to create embroidery designs.
- Sending as-is or nearly as-is graphics, illustrations, or other design products to any outside printer, manufacturer, maker, print-on-demand company, or any other party, so that the outside party can make physical end products on your behalf.
Important Notes:
- This license is valid per user. If multiple team members will be using the files, each must purchase a separate license.
